Sir/ Madam,
Sub: Complaint of Corruption and Fraud in illegal registration of lands in acre to square feet in order to unjustly enrich the private firm “Prakash Silks Pvt.Ltd.” at the cost of the exchequer with regards to lands marked for acquisition for “Green Airport Project”, against Mr. K. V. Srinivasan Addl. IG of Registration Department, Mr. Rajadurai, then Kanchipuram Joint II Sub-registrar and other public servants involved – Registration of criminal case and thorough investigation – Requested.

1. Arappor Iyakkam is a registered organization working towards Transparency and Accountability in Governance.

2. The complaint is about Corruption and Fraud in illegal registration of lands in acre to square feet in order to unjustly enrich the private firm “Prakash Silks Pvt.Ltd.” at the cost of the exchequer with regards to lands falling in the acquisition zone for “Green Airport Project at Parandhur”, against Mr. K. V. Srinivasan Addl. IG of Registration Department, Mr. Rajadurai, then Kanchipuram Joint II Sub-registrar and other public servants involved. It is extremely important to immediately register a FIR, carry out investigation and cancel the illegal registrations immediately. Otherwise, when the Parandhur Airport acquisition happens, the fraud done by the Registration Department public servants in collusion with Prakash Silks will result in a loss of more than Rs 150 Crores to the TamilNadu Government.

Facts of the complaint:
3. Presentation of documents for Registration: On 12th of March 2020, four sale deeds of properties belonging to a private firm named “Prakash Silks Pvt. Ltd.” in Parandhur and Nelvai villages of Kanchipuram District was presented for registration at Kanchipuram Joint II Sub-registrar office. The documents were kept pending with Pending Numbers P.No. 46/20, 47/20, 48/20, 49/20 (Annexure 1 to 4 respectively). The Kanchipuram Joint II SRO held them pending in view of getting some clarification from the District Registrar, Kanchipuram.

4. The 4 sale deeds presented for registration were for registering a small portion of the land in acre as plots (Thani Manai). The following are the pending document property details of Parandhur and Nelvaai village, as per the deed documents (Annexure 1 to 4) filed for registration.

SRO’s Letter : On 26-03-2020, Kanchipuram Joint II SRO wrote a letter (ந.க.எண்.152/2020) to the District Registrar (Annexure 1 – Page 18,19) seeking for clarification on the four pending documents (P.No. 46/20, 47/20, 48/20, 49/20) of Parandhur and Nelvaai village, Kanchipuram district. The SRO raised various issues regarding the pending documents and the key points are mentioned below.

6. The SRO stated in his letter that in the presented documents, the survey number of the land to be registered in square feet has not been mentioned. Instead, the survey numbers and acreage of many lands has been mentioned and that out of these total lands in acres, a small portion in cent/ sq.ft is mentioned for registration. For example: In Pending document number 47, 25 cents or 11000 square feet is proposed to be sold out of 9.05 acres. The survey numbers of 9.05 acres are mentioned as 626, 627/1, 627/2, 627/3, 627/4, 627/5, 627/6, 627/7, 627/ 8, 627/9A, 627/9B, 627/9c, 627/10, 627/12A, 627/12B, 627/13, 632. However, the survey numbers in which the 25 cents which is proposed to be sold out of the 9.05 acres has not been mentioned specifically. The SRO in his letter raised that a small portion alone is being proposed to be sold in square feet out of large extent of lands. If we put together the extent of all the lands in the four documents, 117.5 cents is proposed to be registered in the following manner out of a total of 73 acres

7. The SRO has therefore said in his letter to District Registrar, Kanchipuram that there are discrepancies/ conflict in the acceptance of registration of these documents. After examining the village map, encumbrance certificates and the surrounding survey numbers, it was found that all of them were still lands in acres. The SRO at this point writes about the malafide intention with which these documents seem to have been presented for registration. He says that since “Green Airport Project” is at its conceptual stage, this presentation seems to have been done to convert large extent of land in many survey numbers to square feet. He goes on to say that this is being done to claim compensation value in square feet rather than land in acres during acquisition of lands for “Green Airport Project”. He also says that there is great danger of these registrations causing a huge loss to the Government as guideline values in sq.ft will be much greater than guideline value in acres.

8. The SRO Mr.R.Prakash, Joint II Sub Registrar also mentions that the documents were presented for registration contrary to the circular of IG Registration department. Circular no. (ந.க.எண்.21352/C1/2018 dated 05-07-2018) (Annexure 5). Mentioning all these, the Sub Registrar sought clarifications from the District Registrar, Kanchipuram.

9. District Registrar’s reply letter : On 15-06-2020 Kanchipuram District Registrar Mr. S. Balasubramanian wrote a reply letter (ந.க.எண்.2137/ஆ1/2020) to Kanchipuram Joint SRO (Annexure 1 – Page 20,21) stating that the act of permitting the presentation of the documents (P.No. 46/20, 47/20, 48/20, 49/20) by the registration official responsible is contrary with the circular (ந.க.எண்.21352/C1/2018 dated 05-07-2018) of IG Registration since none of these four documents have specifically mentioned in the document as to which survey number each of the proposed land to be registered in square foot is situated.

The District Registrar also mentions that at the time of presentation of the documents itself, the registration official responsible should have returned the document asking them to mention the specific survey numbers for the lands to be registered, as per the registration act 1908, section 22. He goes on to clarify clearly that there is no way in which the above set of lands could be registered given that they violate the circular of IG Registration.

11. At this point, it is crucial to also point out to the contents of the circulars as mentioned in Annexure 5. Circular No (ந.க. எண்.21352/C1/2018 dated 05-07-2018) of IG Registration states that no registration shall be carried out if the survey number of the land to be registered in square feet is not mentioned specifically. Therefore, the above presented documents clearly violate the circular as rightly pointed out by the SRO and the District Registrar in return. Another circular No 29945/C1/2015 dated 21.06.2017 (Annexure 6) also clearly says that no unapproved layouts shall be registered based on a series of court orders of the Hon’ble Madras High Court. Therefore, the above presented documents should have been returned.

Hence, based on the clarification given by district registrar and also abiding to the circular from IG registration, the documents were not registered by Kanchipuram Joint II SRO by Sub Registrar Mr.R.Prakash. However, the Sub Registrar Mr.R.Prakash who refused to register the above lands based on the advice of the District Registrar was transferred by the Registration Department and another Sub Registrar named Rajadurai was brought in his place.

13. Letter from Addl. IGR to SRO: Out of nowhere, on 16-06-2020, Mr. K.V.Srinivasan, Additional IG Registration department via Letter Number : எண்.15141/சி1/2020 (Annexure 1 – Page 16,17) sends a letter to Sub Registrar Joint II directly. In the letter he claims that he received a petition from Mr. K.N. Ganesh Shah on 11.06.2020, that documents to be registered in the name of Prakash Silks and Pvt Ltd and Prakash Properties Holdings Pvt Ltd were kept pending at the office of Kanchipuram Joint II SRO seeking NOC for Registration. The letter said that just because the lands were mentioned in square feet in the property details, it is not necessary to ask for a “No Objection certificate”. He also mentions that it is not right to ask for plot specification details since there is nothing fundamental pointing to such things in the document. Addl. IGR Mr. K.V.Srinivasan tells the Sub Registrar to consider them as individual plots (thani manai), fix their guideline value, register them and to release it after registration to the petitioner immediately. He also tells the Sub Registrar of Kanchipuram Joint II to update him on the action being taken in the above matter.

14. SRO’s letter to Deputy IGR: The new SRO writes a letter (Letter No – ந.க.எண். 152/2020 dated 03-07-2020) to Deputy IG Registration Department (Annexure 1 – Page 22 to 24) mentioning all the above communications between, SRO, District Registrar and Additional IG, Registration and sought DIG’s clarification with respect to whether he should fix guideline value and register the lands above 20 cents as plots as directed by Additional IG or not allow the registration as per District Registrar’s letter. While there is no reply letter in the official communication set of documents, Kanchipuram Sub Registrar Joint II Mr. Rajadurai registered all the four pending documents on 29th of July 2020 through Document Nos. 2976/ 2020, 2977/2020, 2978/2020 and 2979/ 2020 (Annexure 7 to 10).

15. The above set of communication shows that by violating section 22 of the Registration Act and violating various circulars of the Registration Department, Additional IG K.V.Sreenivasan, Sub Registrar Rajadurai and owners of Prakash Silks & Sarees Pvt Ltd. colluded to register documents in square feet. For example, in Document Number 2976 of 2020, instead of mentioning the survey number of registered land alone, by mentioning all the survey numbers in the registered document and by mentioning them in square foot, it has set the stage to manipulate and award compensation for a much higher amount. The guideline value of the survey numbers in Doc No 2976/ 2020 is shown as Rs 8,71,000 per acre only. However, 49.5 cents of land has been registered in square feet for Rs 32,40,000. In the EC of Doc 2976 of 2020, it can be seen that both the market value and the consideration value for 49.5 cents or 21600 sq. ft has been mentioned as Rs 32,40,000. This means the guideline value of 1 acre or 43560 square feet has been increased to Rs 65,45,455. This drastic increase from Rs 8,71,000 to Rs 65,45,455 through fraud and manipulation by registration department will potentially lead to a huge loss to the exchequer at the time of acquisition. Similar fraud and manipulation has happened in the other documents as well.

16. The potential loss to the Government due to the above issues.
Total Acres of survey numbers with Prakash Silks & Sarees Pvt Ltd mentioned in the fraudulent Documents = 73 acres
Compensation for 73 acres at 4 times the guideline value for rural areas if guideline value for Prakash silks land was taken as Rs 8,71,000
= 73 acres * Rs 8,71,000/ acre * multiplier 4
= Rs 25,43,32,000
Compensation for 73 acres at 4 times the guideline value for rural areas if guideline value for Prakash silks land was taken as Rs 65,45,455
= 73acres *Rs 65,45,455/acre*multiplier 4
= Rs 191,12,72,860
Potential Loss to the Government and exchequer if these fraudulent documents are not cancelled
= Rs 191,12,72,860 – Rs 25,43,32,000
= Rs 165,69,40,860 = Rs 165. 69 Crores

17. Apart from this, by registering in square foot of an agricultural land in acres, this also violates the orders of the High Court with respect to the registration of unapproved plots.

18. The involvement of senior officials such as K.V.Srinivasan who is the Additional IG of Registration and then sub registrar Rajadurai has been proved in this complaint with clear evidence. Also, the superintendent who signed the communication letter between Additional IG and Sub Registrar also needs to be investigated. The ongoing massive corruption and fraud activities in the Department of Registration exploited by unscrupulous registration authorities needs to be act upon with immediate effect. Criminal action of Corruption, Fraud and violation of Registration Act, 1908 should be taken against the wrongdoing officials, and they should be strictly prosecuted according to the law.

19. Therefore, we request you to immediately register FIR against Mr.K.V.Srinivasan, concerned SRO along with the private firm involved in causing heavy loss to the Government who deliberately executed and registered lands in acre to square feet for their personal gain hiking the property market value high and carry out a detailed investigation on the same.

20. We request you to immediately take the following actions
a. Register a FIR and initiate investigation on Additional IG K.V.Srinivasan, Sub Registrar Rajadurai and others involved
b. Suspend Additional IG K.V.Srinivasan and other public servants involved immediately and initiate departmental enquiry.
c. Take action under Prevention of Corruption Act, fraud for IPC and also for violation of Registration Act 1908
d. Use the new amendment to Registration Act to cancel the documents mentioned in the complaint and take further criminal and departmental action.
e. Ensure that the manipulated increased guideline values are cancelled.
